Go Rogue Mr. Prime Minister

Dear Prime Minister:

You recently received a letter from my best bird friend, @politijim.  While his letter was excellent, I believe it falls short of providing a timely solution to the Keystone Konumdrum.  We the People of the United States need oil in the worst way.  We need to find a way to build our pipeline regardless of our silly Presidential politics.

Mr. @politijim suggested that you give this once great country some time to replace our Teleprompter-Reader-in-Chief with a real Commander-in-Chief.  He believes, as do I, that when that happens the pipeline will get built.  However, I don’t think either of our countries can afford to let this project sit idle for a year.  I am suggesting to you, and by copy of this letter to the Governors of the States of Montana, South Dakota, Oklahoma and Texas, that we begin construction immediately.

Prime Minister Harper, if you seek to sell oil, if you seek prosperity for Canada and the United States, if you seek conservatism: Come here to our border!  Mr. Harper, open the gate-way to your oil!  Mr. Harper, tear down Obama and let’s build a pipeline!

It’s time to Go Rogue Mr. Prime Minister! 

While on the surface this may seem like a very radical action, I can assure you it is not.  Our nation is currently in the process of being fundamentally transformed.  What we once thought of as our unalienable rights are now a few laws away from being erased forever.  Some actions that we thought were legal are now illegal and other actions that we thought were illegal are now being allowed without prosecution.  Not since the days of the Wild Wild West has lawlessness been so well protected. 

As you are well aware, our country has done very little to control the flow of activity across our southern border.  Every hour of every day there are multiple pipelines of people, drugs, guns, criminals, terrorists & who knows what else, streaming into the USA.  Every State that tries to toughen up its laws to stem the flow of illegals is served with a law suit by our Golfer-in-Chief.  Why should we treat our Canadian border any differently?  To do so would be racist, right? With the importing of your oil having been deemed unwelcome that is the signal to begin “sneaking” it in. (Wink, wink.)    

I see no down side to Canada by beginning this project now.  As @politijim so brilliantly detailed, outside of an act of war, your relationship with our country couldn’t get any worse.  By the time the Obama administration figures out we have begun this project, if they actually do figure it out, our Campaigner-in-Chief will be busy trying to get re-elected, leaving him insufficient time to direct his “laser like focus” on stopping the Keystone Pipeline. 

To the Governors of the States which this pipeline will pass through, it is time to rid the toxins from the ground along the route of the Keystone Pipeline.  Yes, the contamination is leaking into your water systems and is causing a rise in ratings for MSNBC.  It must be cleared now before it infects the whole nation.  Once you have removed the contaminated soil you will need to bury many pipes, the specs for which will follow soon.  These pipes will prevent any further contamination to any other soil.  Note that is very important that these pipes be connected using the best leak proof products available in today’s market. We don’t want anything to get inside them.

Mr. Prime Minister, I am sure you are concerned about what the fallout would be if the press catches wind of what we were doing.  Please don’t worry about this. The media in our country works for our Liar-in-Chief, spewing on his behalf more nonsense than there is oil in your city of Hardisty.  No one with any real intelligence takes what our media says seriously.  (In fact, some of the best journalism about the United States comes from websites based in Canada.)  So if the press finds out and if they call you, just tell them you’ll talk after our Food-Stamp-Provider–in-Chief provides a real birth certificate, an explanation for his social security # and releases his college transcripts.

Another concern you might have is will the President stop the flow of oil by capping the pipeline?  He might try, but we are not very good at it.  We couldn’t cap the leaking oil well in the Gulf.  We keep blowing through our spending cap like it is monopoly money.  And all of our ball caps are made in other countries. 

(There is one thing that we have become good at capping, our economy.  Our Vacationer-in-Chief has every Marxist Czar working in our government placing its proverbial “boot on the throats” of capitalism, free enterprise and the rights of the individual.  His decision to not allow the building of the Keystone Pipeline is part of his “Boot on the Throat” policy.)

My little bird friend, @politijim, offered your country something for your trouble.  I would like to sweeten the pot.  In addition to all that has been offered, how would you like for Canada to be the country at this year’s Summer Olympics to win the most medals?  Just say yes and we will arrange for O Canada to be the most played song in London this summer.

Hammer Time?


Is this statement by President Obama on January 5, 2012 the final nail in the coffin of our Constitutional Republic?

“But when Congress refuses to act, and as a result, hurts our economy and puts our people at risk, then I have an obligation as President to do what I can without them.  I’ve got an obligation to act on behalf of the American people.  And I’m not going to stand by while a minority in the Senate puts party ideology ahead of the people that we were elected to serve.  Not with so much at stake, not at this make-or-break moment for middle-class Americans.  We’re not going to let that happen.”

Stunning.

This statement was made in the context of the President making an unconstitutional appointment of Richard Cordray as Director of the Consumer Financial Protection Bureau.  The appointment was unconstitutional because it violates Article II, Section 2, Clause 3 of the Constitution which says:

“The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.”

The Senate was not in recess on January 5, 2012.  In order for the Senate to be in recess Article I, Section 5 of the Constitution says:

“Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting.”

The House did not consent to a Senate adjournment. Therefore, every three days the Senate must hold a session.  The last session it held before January 5th was on January 3, 2012 and it held a session on January 6th.

There have been two Presidential impeachments by the House in our nation’s history.  The first took place in 1868.  The primary charge against President Andrew Johnson was his violation of the Tenure of Office Act.  This act, which no longer exists, required the President to seek the advice and consent of the Senate to remove someone that was previously appointed with the advice and consent of the Senate. 

Johnson was at odds with Secretary of War Stanton.  He removed Stanton without first seeking the consent of the Senate.  (Johnson believed that the Tenure of Office Act, which passed over his veto, was unconstitutional.)  He then filled the vacancy with Lorenzo Thomas, also without the advice and consent of the Senate. The House convened shortly after Johnson’s actions and drew up eleven articles of impeachment. Ten of the eleven articles were directly related to different aspects of the violation of the Tenure of Office Act.  Article of Impeachment 3 read as follows:

“That said Andrew Johnson, President of the United States, on the 21st day of February, in the year of our Lord 1868, at Washington in the District of Columbia, did commit, and was guilty of a high misdemeanor in office, in this, that, without authority of law, while the Senate of the United States was then and there in session, he did appoint one Lorenzo Thomas to be Secretary for the Department of War, ad interim, without the advice and consent of the Senate, and with intent to violate the Constitution of the United States, …”

President Obama’s actions on January 5, 2012 are very similar to what President Johnson was impeached for 134 years ago.  In fact, by filling in the blanks, I find that I am able to draft the one and only article of impeachment required today:

That said Barack Hussein Obama, President of the United States, on the 5th day of January, in the year of our Lord 2012, at Washington in the District of Columbia, did commit, and was guilty of a high misdemeanor in office, in this, that, without authority of law, while the Senate of the United States was then and there in session, he did appoint one Richard Cordray to be Director of the Consumer Financial Protection Bureau, ad interim, without the advice and consent of the Senate, and with intent to violate the Constitution of the United States.

Regardless of whether a conviction can be achieved in the Democrat controlled Senate, impeaching the president for this flagrant, unlawful act is the absolute duty of the House.  The Tea Party members that we elected in 2010 all talked about the need to protect and defend the Constitution.  Was that just talk or are they going to act?

It is Hammer Time! We either put the hammer down on this lawless president through impeachment or we hammer shut the coffin that contains our Constitution.

Where is the Power?


The constitutional question regarding clean air is not whether we will have it; the question is who defines the issue and gets to make the laws or rules.  The choices are the Federal Government, State (and Local) Governments or We the People.

Madison wrote, in Federalist Paper #45, “The powers delegated by the proposed Constitution to the federal government, are few and defined. Those which are to remain in the State governments are numerous and indefinite.”

The powers delegated by the Constitution are listed, primarily, in Article I, Section 8.  If there is not an enumerated power that references this issue then we look at the 9th Amendment which says, “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people” and the 10th Amendment which says, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” 

Question – Is there an enumerated power regarding clean air?  

Answer – No.

Therefore the States or the people get to define and legislate standards for this issue.  If we want the Federal Government to define and regulate this issue there is a process for amending the Constitution, which we have done 17 times since the first 10 amendments were adopted.

Everyone should read the Constitution, the Federalist Papers and the Anti-Federalist Papers.

No Rest

With Obama on vacation I thought it would be a good time to recall his promises not to rest. (Also can be found at marklevinshow.com):

  • April 9, 2009 "And we will not rest until we reach a day when not one single veteran falls into homelessness" 
 
  • May 11, 2009 "I will not rest until the dream of health care reform is finally achieved in the United States of America" 
 
  • November 2, 2009 "We will not rest until we are succeeding in generating the jobs that this economy needs"
 
  • November 23, 2009 "I will not rest until business are investing again, and businesses are hiring again"
 
  • January 28, 2010 "We will not rest until we build an economy that's ready for America's future"
 
  • March 5 2010 "I’m not gonna rest & my administration is not gonna rest in our efforts to help people who are looking to find a job"
 
  • May 26, 2010 "We will not rest until this well is shut, the environment is repaired and the clean up is complete"
 
  • July 8, 2010 "My administration will not rest until every American who is able and ready and willing to work can find a job"

Ironically, Obama is the most rested President in my lifetime.  By the grace of God Americans will hopefully soon give him the opportunity for an extended vacation.  While Obama's supporters are resting in various occupied parks, Constitutional Conservatives are working around the clock to vote him out of office on November 6, 2012.

To Debate or Not To Debate

So Donald Trump invites the leading Republican candidates to a debate and all but two, Newt Gingrich and Rick Santorum, decline.  This is odd given the celebrity of Trump will likely cause some people who have not watched the debates or who are bored with the current debates to give the candidates some of their TV viewing time. Here are the candidates excuses in the order in which they declined:

  1. John Huntsman – Thought debate would require kissing
  2. Ron Paul – Trump is a distraction
  3. Mitt Romney – Too busy focusing on two other debates
  4. Rick Perry – Too busy
  5. Michele Bachmann – Not really sure why she is not participating

Understandably, Trump is rumored to be considering canceling the debate, although it is not clear if it is his to cancel.  However, canceling this debate means the terrorists (RINOs) win.  The Republican establishment is trying to control the process.  They are desperate to keep outsiders like the Tea Party and Trump from having too much influence on the GOP campaign. Republican National Committee Chairman Reince Priebus bluntly expressed concern with the debate because Trump won’t rule out an independent run.  Apparently the way to make The Donald less likely to run is to run away from him. The GOP establishment is twisting the arms, legs and necks of the candidates to not participate in the Trump debate.


Should Trump cancel this debate? It’s not very often that I find myself in a position to give advice to The Donald so I’m going to jump all over the opportunity.  I say:
  1. Do not cancel the debate.
  2. At the start of the debate announce the names of all the candidates that were invited as if they were to come on stage.  Have podiums or seats available for them.
  3. First question to Gingrich and Santorum.  Do you have any comments to make regarding the five candidates that choose not to attend this debate?  
  4. Stick to issues that you have substantial knowledge on, such as China, real estate, business, etc.  Use your knowledge to challenge the candidates’ responses.  If you are not fluent on a topic, don’t bring it up.
  5. Final question to the candidates should be, “I’m having another debate two days before Super Tuesday.  Will you attend?”
And lastly and most importantly, be The Donald!  One of these men may be our President which means he will be working for you and me.  Let’s make sure that we hire the right guy.

Constitution Slaughtering


On November 30, 2011 Congress lifted a ban that it had put in place in 2007 that resulted in the prohibition of slaughtering horses for food consumption.  A quick search of the web revealed the expected headlines:

Also on the web were reactions like these:

“I couldn't sleep last night after hearing this. I am sick to my core & frightened to think about the future of our horses. I'm at a loss for words... greed appears to be the prevailing compass in our society, overshadowing both commonsense & moral constitution. *tears*”

“This puts it in perspective. Pardon a single turkey while sentencing thousands of horses to a horrible death”

“There are lots of other animals out there for human consumption other than beautiful horses. So rethink this for all the horse lovers out there in this world. Would you like it if they made dog and cat slaughter houses and use your pet?”

I understand why people are upset. What I don’t understand is why they are not outraged over an even more inhumane slaughtering that is taking place, the slaughtering of the Constitution.

The question all Americans should be asking is:

Where in the Constitution is the enumerated power granting the federal government the ability to regulate the slaughtering of horses (or any other animal for that matter?)

The enumerated powers are found in Article I, Section 8 of the Constitution. There is nothing in this Article I, Section 8 remotely resembling a constitutional power to ban or not ban the sale of horse meat and the slaughtering of horses for their meat.  So absent a specific enumerated power in the Constitution, how does the Constitution want us to deal with this issue?  The answer is found in amendments 9 and 10:


Amendment 9 - The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Amendment 10 - The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

This is so simple even our Congressmen should be able to understand it. Absent an enumerated power, each state decides whether or not horses can be slaughtered in their state and whether or not horse meat can be sold for consumption.  Absent any state laws prohibiting horse slaughtering or sale of meat for consumption, the power to decide belongs to the individual.

Constitutional Slaughtering is happening every day and is exponentially worse under the Obama regime.  Each time it happens “We the People” lose more of our liberty.  When our Federal Government attempts to violate the constitution, no matter what the issue, we need to react.  We need to let them know that we choose liberty over tyranny, freedom over slavery.  We took the first step towards restoring our constitutional Republic in 2010.  We need to take another step in 2012.
